Policies
How a trip with us is planned, confirmed and paid for — and what each of us is responsible for along the way.
Draft — please read before relying on this. These terms are a working draft written as a reasonable starting point for a small Indian tour operator. They have not been reviewed by a lawyer, and specifics such as advance amounts and payment deadlines are sensible industry defaults rather than figures confirmed by the business. Please have a legal professional review and adjust this page, and confirm every number in it, before it governs real bookings.
These terms apply to tours planned and operated by Banjari Himachal Tours, 940/1 Yadav Colony, Jabalpur, Madhya Pradesh 482002, and to your use of this website. By confirming a booking with us you accept them.
We do not take instant online bookings. Every trip goes through the same simple sequence:
A quote is valid only for the dates, hotel category and group size it was prepared for. Availability in the mountains moves quickly, particularly around long weekends, Diwali, Christmas and the peak snow weeks, so a price is confirmed again at the moment of booking.
A typical package covers hotel stay on double-sharing with daily breakfast, a private cab for the whole trip with an experienced hill driver, all toll taxes, parking, state permits and green tax, driver allowance and fuel, the sightseeing listed in the day-wise plan, and on-trip support. Lunch and dinner unless mentioned, entry tickets, ropeway and adventure activity fees, personal expenses, travel insurance and anything not listed as included are not covered. Your own itinerary is the authoritative list — it overrides any general description on this website.
Himachal is a mountain state and plans occasionally have to bend. Landslides, snowfall, roadblocks, pass closures, heavy rain, strikes, government orders and hotel-side problems can all force a change. Where that happens we will re-route or re-arrange your trip as close to the original plan as we reasonably can, and tell you as soon as we know. A hotel may be substituted with one of a similar standard if the booked property becomes unavailable.
Any additional cost arising from such changes — extra nights, longer routes, a road that has to be taken around a closure — is not part of the original package and is payable by you. This mirrors the "extra cost from landslides, roadblocks or weather changes" exclusion that appears on every itinerary.
Cancellations, refunds and force-majeure situations are covered in our Refund & Cancellation Policy, which forms part of these terms.
We plan your trip and book the hotels, cabs and services it needs. Those services are delivered by independent suppliers — hotels, homestays, transport operators, drivers, activity providers — who are responsible for the standard and safety of what they provide. We select suppliers with care and visit the properties we use, but we do not own or operate them.
We are not liable for loss, delay, injury, illness or damage caused by circumstances outside our reasonable control, including weather, landslides, road and pass closures, vehicle breakdown, natural disaster, epidemic, strike, civil unrest, accident, government action, or a supplier's own failure or negligence. Optional adventure activities — paragliding, skiing, rafting, ropeways, snow sports — are booked and undertaken at your own risk with the operator concerned.
Where we are found liable, our liability is limited to the amount you paid us for the package.
The text, photographs, itineraries and design on this site belong to Banjari Himachal Tours and may not be copied or republished without our permission. Package descriptions, prices and photographs are published in good faith and may change; they are an invitation to enquire, not a binding offer. See our Disclaimer for more on accuracy and third-party links.
If something goes wrong during your trip, tell us while you are still on it — our support number stays with you and most problems can be fixed the same day. Complaints raised after a trip has ended are far harder to put right. Write to us within a reasonable period of returning and we will look into it properly.
These terms are governed by the laws of India. Disputes relating to a tour operated in Himachal Pradesh will be subject to the jurisdiction of the competent courts there; disputes relating to our office and business operations will be subject to the courts at Jabalpur, Madhya Pradesh. The exact jurisdiction clause should be confirmed with a legal professional.
